Elite beauty terms, conditions and disclaimer

These Terms and conditions govern the supply of goods sold by elitebeauty.co.uk, T/A Elite, Elite Beauty, and Elite Health & Beauty, of 43 Somerville Road, Sutton Coldfield, West Midlands, B73 6HH.

Terms and conditions do not affect your statutory rights as a consumer. The consumers statutory rights are not excluded or limited in any way in accordance with the Sale of Goods Act 1979 (as amended).

Purchasers are required to accept our full terms, conditions & disclaimer before products are dispatched.

Price and Payment.
We must receive payment for the whole of the price of the goods we supply to you before delivery unless we have agreed otherwise in advance in writing.

The prices shown include all relevant taxes.

Samples.
Samples are provided for you to try products before you buy the larger versions; this is not intended to replace a skin consultation. A maximum of 4 free samples will be provided for each product bought costing over £8. No more than 4 of the same sample will be provided per order. It is possible to order samples without buying a product, however a maximum of 4 samples will be provided. Some samples carry a small charge and may also be subject to other restrictions such as only one per order - please refer to the individual product pages for product specific details..

Delivery Charge Details.
Delivery will be free for all orders delivered to Mainland England, Wales, Northern Ireland and the Scottish Lowlands that are over £70.

For all orders delivered to Mainland England, Wales, Northern Ireland and the Scottish Lowlands that are £70, or under, we charge a small shipping and handling fixed fee of £2.50.

Delivery to BFPO (HM forces overseas), Scottish Highlands and Islands, Isle of Man, Scilly Isles, Channel Islands and the Isle of Wight is the same as that for the UK. However, the delivery times may take slightly longer.

*Please note that the delivery rates and service levels apply to UK orders. Delivery outside UK will be ONLY by prior special agreement with Customer Services. For further information regarding delivery to your area please click here to mail us.

Where the order is upgraded to Express Delivery, guaranteed delivery is provided by the Royal Mail however, it is limited to 99.12% of orders, it is not a 100% guarantee.

The most cost efficient shipping method will be used when sending your purchase.

Delivery Schedule.
Most orders are despatched either the same day or next business day. Very occasionally orders may take longer than 5 working days to despatch and on such rare occasions we will notify you first about the delay so that you have the opportunity to cancel your order if you wish.

Recommend a Friend Discount Scheme.
Recommend us to friends and colleagues. For each person recommended - If they don't already exist on our contact database then when they place their first order over £10 we will send you an electronic 5% discount voucher for use on a subsequent order.

Discount vouchers can only be used once and will automatically expire one year after they have been issued. Elite reserve the right to withdraw discount vouchers if we believe someone is abusing the system. You can only redeem one voucher per order. Recommendations made before this scheme was introduced are not eligible for discount vouchers. To qualify for a voucher the referred colleague or friend must not already exist on our customer database. Discount vouchers are issued to the person making the referral and are not transferable. Each person must have a unique E-mail address; Shared E-mail addresses are not eligible. Where someone has more than one E-mail address, e.g., work and home, they will only qualify once.

Cancellation/Returns.
If the customer changes their mind for any reason within 6 hours of placing an order and as long as the order has not already been despatched, we will accept cancellation of the order.

Faulty goods should be returned within 7 working days from receipt (subject to proof of purchase and notification to Elite of your intention to return the goods).

In accordance with the Sale of Goods Act 1979 (as amended) consumers may also return goods which do not conform to the contract.

The consumer has the right to cancel or return their order / purchase within 7 working days from receipt of the original order / purchase without giving a reason, subject to the goods being unused in original packaging and in a re-saleable condition.

If you have notified us of a problem with the goods, we will (at your option) either make good any shortage or non-delivery, replace or repair any goods that are damaged or defective upon delivery, refund to you the amount paid by you for the goods in question.

You must contact Elite to obtain a return number prior to returning any goods. No goods will be accepted without this.

We will not be liable to you for any loss of profits, administrative inconvenience, disappointment, indirect or consequential loss of damage or damage arising out of any problem in relation to the goods and we shall have no liability to pay any money to you by way of compensation other than any refund we make under these conditions.

Elite Beauty may cancel any order without further consultation with the customer upon full refund of monies paid, less any expenses incurred where the order has already been despatched.

You are responsible for goods until they are recieved by Elite. It is strongly recommended that you obtain a proof of posting receipt in case your returned products go missing and you need to claim the cost back from the Royal Mail.

You may be charged the full cost of posting the original order to you and any reasonable costs incurred if the order is returned and is not faulty.

Guarantees and Warranties.
All guarantees, warranties and assistance from Elite are offered in addition to your statutory rights as a consumer.

Complaint Handling Procedure.
The Company endeavors to respond to complaints within 5 working days. We always endeavor to handle complaints fairly and swiftly. Keeping the customer informed about progress. Feedback on how we can improve our service is always welcome. In all cases please do not hesitate to contact us

Whilst using beauty products you must follow all manufacturers instructions at all times.

Beauty products are sold for personal use only. The application of beauty products by the customer to a third party is expressly prohibited and Elite accepts no liability for such third party application.

Neither the manufacturers nor the retailers are liable for personal or other damages however caused. The owner takes full responsibility.

Force Majeure:
We shall have no liability to you for any failure or delay in supply or delivery or for any damage or defect to goods supplied or delivered hereunder that is caused by any event or circumstance beyond our reasonable control (including, but not limited to, act of God, acts of terrorism, strikes, and other industrial disputes).

Governing Law and Contract Information.
No contract will subsist between you and Elite for the sale by it to you of any product unless and until Elite accepts your order by Email confirming that it has been processed and subject to the aforementioned delivery charge details clauses. That acceptance will be deemed complete and will be deemed for all purposes to have been effectively communicated to you at the time Elite sends the Email to you (whether or not you receive that Email). For the avoidance of doubt, any such contract will be deemed to have been concluded in the United Kingdom. Further, any such contract will be interpreted, construed and enforced in all respects in accordance with the laws of England, and you and Elite irrevocably submit to the non-exclusive jurisdiction of the English Courts.

We at Elite respect your rights as a consumer. Elite are dedicated to protecting your privacy to the full extent of the UK data protection acts of 1984 and 1998.

We only collect information through the ordering/registration process, from your skin consultation form, or from your telephone, mail or Email enquiry. We only collect information that is required specifically to create a more personal shopping experience, perform a skin consultation, and to process your orders. Information may also be used to manage our business, for our confidential research and analysis and for marketing purposes. The type of information we will collect about you consists of: Your name, address, phone number, Email address, credit/debit card details and general health information in respect of skin consultations. We will never collect sensitive information about you without your explicit consent. The information we hold will be accurate and up to date. If we intend to transfer your information outside the EEA (European Economic Area) we will always obtain your consent first.

The information that we hold about you can be held on paper and/or on computer and/or in other electronic forms. It may be kept for a reasonable period of time after your last transaction or contact.

The information you provide is kept securely, we follow strict security procedures concerning the storage and disclosure. We may require proof of identity before sensitive information is disclosed to you. We will not disclose information about you to anyone else (other than our agents or other third parties performing any of the above activities on our behalf) unless we are required to do so by law.

You have a right to receive a copy of data we hold about you.
